Unless otherwise stated, FES2 Inc. is responsible for the processing of personal information collected through SpicyDream.ai.
By accessing or using the Services, you acknowledge that your information will be handled as set out in this Privacy Policy. If you do not agree with these practices, please discontinue use of the Services.
2. What We Collect
The information we collect depends on how you interact with SpicyDream, and may include:
- Account details — your email address, user ID, sign-in status, subscription tier, remaining credit balance, and saved account preferences.
- Content you provide — images, videos, prompts, reference files, and generation settings that you upload or submit so we can fulfill your requests, together with any generated results you choose to keep in your assets or history.
- Purchase and billing records — the plan or credit package purchased, time of purchase, payment and refund status, invoice identifiers, and metadata passed to us by app stores or payment processors. Full payment card numbers are never stored on our systems.
- Device and usage information — pages visited, features used, generation activity, error reports, browser and device type, IP address, approximate location inferred from IP, language settings, operating system, and related diagnostic data.
- Trust and safety signals — provider-reported censored or content-sensitive outcomes, user reports, fraud and abuse indicators, policy compliance reviews, and security signals connected to use of the Services.
- Consent and confirmation records — records of whether and when you confirmed that you hold the necessary rights, permissions, or consent for materials submitted for video generation.
- Correspondence — support tickets, feedback, survey answers, and any other messages you send us.
- Cookies and similar technologies — used for sign-in, session continuity, analytics, attribution, fraud prevention, and remembering your preferences.
3. How We Use Your Information
We use the information described above to:
- Deliver, operate, maintain, and improve the Services, including AI image and video generation, editing, storage, downloads, and management of your saved assets.
- Process the uploads, prompts, settings, and outputs involved in requests you initiate.
- Verify your identity and manage accounts, subscriptions, credits, payments, refunds, and purchase restoration.
- Identify, prevent, and respond to fraud, abuse, security incidents, spam, unauthorized access, and policy violations.
- Apply request validation and SFW prompt constraints, respond to provider-reported censored or content-sensitive outcomes, review user reports, and carry out legal compliance and quality assurance checks.
- Record and verify the rights, permission, consent, safety, and policy confirmations connected to video generation.
- Understand how the product is used, diagnose bugs, measure performance, improve the user experience, and build new features.
- Provide customer support, answer inquiries, deliver service notices, and share updates about our policies or products.
- Meet our legal obligations, enforce our agreements, and protect the rights, safety, and property of SpicyDream, our users, and others.
4. How AI Content Is Processed
SpicyDream is an AI creative platform. Generating or editing images and videos requires us to process the files, prompts, settings, and other inputs you supply. Source images and videos you upload are used only to carry out the specific generation or editing request you make. They may be passed to infrastructure providers, AI model and generation providers, storage providers, and CDN providers strictly to the extent needed to deliver and secure the Services you requested. AI model and generation providers may apply their own safety controls when processing a request.
We do not keep uploaded source files unless retention is needed to complete your request, maintain assets or history you have chosen to save, investigate errors, prevent abuse, satisfy legal requirements, or enforce our Terms. Once retention is no longer needed, source files are deleted or de-identified. We do not collect or retain facial data, do not use uploaded images to identify you by your face, and do not build facial recognition profiles. Your uploaded content and generated outputs are never used to train AI models.
5. When We Share Information
Information may be disclosed to the following categories of recipients:
- Service providers and processors that host, store, transmit, generate, secure, analyze, or otherwise support the Services on our behalf.
- AI model and generation providers that process your inputs in order to produce the outputs you request.
- Payment processors, app stores, banks, and tax or billing providers involved in handling purchases, subscriptions, refunds, and fraud screening.
- Analytics, attribution, and advertising measurement partners that help us evaluate product performance and marketing effectiveness.
- Legal, compliance, safety, and security partners, where necessary to protect rights, enforce our terms, investigate misuse, or meet legal requirements.
- Professional advisors, auditors, insurers, or parties to a corporate transaction, in connection with financing, a merger, an acquisition, a restructuring, or a transfer of assets.
We never sell your uploaded images or generated content. Where applicable law characterizes certain analytics or advertising disclosures as a "sale" or "sharing" of personal information, you may exercise the opt-out rights described in Section 7.
6. How Long We Keep Information
We keep information only as long as reasonably needed for the purposes set out in this Privacy Policy, unless applicable law requires or allows a longer period.
- Account and purchase records are kept while your account remains active and thereafter as needed for tax, accounting, dispute resolution, fraud prevention, and other legal obligations.
- Uploaded source images and videos are not retained unless needed to complete your request, maintain assets or history you have chosen to keep, investigate errors, prevent abuse, satisfy legal requirements, or enforce our Terms.
- Generated outputs you save to your assets or history remain available until you delete them, your account is deleted, or continued retention is no longer necessary.
- Temporary processing files, failed uploads, logs, cached data, and provider safety outcomes or abuse reports may be kept for a limited time to support reliability, security, abuse prevention, and troubleshooting.
- Records of rights and policy confirmations may be kept while your account is active and as needed to demonstrate compliance, resolve disputes, prevent abuse, and enforce our Terms.
- Aggregated or anonymized data that can no longer reasonably identify you may be kept for analytics, reporting, and improving the Services.
7. Your Rights
Depending on where you live — including the European Economic Area, the United Kingdom, Switzerland, California, and other jurisdictions with comparable privacy laws — you may be entitled to:
- Access, confirm, or obtain a copy of the personal information we hold about you.
